Terms and conditions for advertisers

What the platform does

Comunicate.top arranges the publication of advertising articles (advertorials) on websites run by third parties or by SC ARC MEDIASOFT SRL. You order a publication, we pass it to the site you chose, and the article appears there.

Advertising labels

Romanian Law 363/2007, Annex 1 point 11, classes it as an unfair commercial practice **in every case** to use editorial context to promote a product that has been paid for without saying so clearly, in a form the reader can easily identify.

The label is each publication's own decision, as the editor of its site. Some put "(P)" or "Advertorial" in the title, others a note at the end of the article or a dedicated category, others do not label at all. What each one chose is written in the catalogue, next to the price, so you see it before you order. We pass the article on as you wrote it; we neither add nor remove any label.

Responsibility for unlabelled advertising rests with everyone involved, including you as the party being promoted. The publication's choice is shown precisely so the decision is yours, made knowingly.

Your content

It stays yours. You grant us the right to transmit and publish it on the sites you choose. You warrant that you have the right to publish it and that it infringes nobody's copyright, trade mark or image rights.

We do not accept illegal content, or content about tobacco (including electronic cigarettes and accessories), gambling without an ONJN licence, or weapons, nor misleading advertising, which includes phrases such as "the best" with no verifiable basis.

Prices and payments

All displayed prices are **excluding VAT**. VAT is added on the invoice, at the statutory rate in force on the date of issue. Topping up the account is invoiced at the moment of payment; publications are deducted from the available balance, at the site's net price at the time of the order.

What we guarantee and what we do not

We guarantee that we transmit the article to the chosen site and that we tell you if publication failed. We do not guarantee search engine positions, traffic, indexing or that the article stays up indefinitely: the sites belong to third parties, and their editorial decisions are not ours.

If a publication fails through our fault or the site's, the amount is returned to your balance.

Changing and deleting published articles

Both can be requested from the platform. Every request goes through an administrator's approval, whatever the circumstances, because a change on somebody else's site is not made automatically.

Liability

Our liability is limited to the amount paid for the publication in question. We are not liable for indirect losses or lost profit.

Termination

You may close your account at any time. Unspent amounts are refunded on request, less any fees already withheld by the payment provider. Publications already carried out remain carried out.

Governing law

This contract is governed by Romanian law. Disputes are settled by the courts having jurisdiction at the registered office of SC ARC MEDIASOFT SRL, if no agreement is reached.
